What is Vehicle Value Loss?
Vehicle Value Loss Calculation in Turkey is the difference between the value of a vehicle as a result of a traffic accident, damage or repair operations resulting from the accident, and its market value if it had never had an accident.Vehicle depreciation is the difference between the undamaged market value of a motor vehicle before the accident and its value after it has been repaired after the accident. As a result of an accident, the value of the vehicle involved in the accident will be lower than the value of the undamaged vehicle, even if it is completely repaired. In this case, there is a loss of vehicle value. Because, even if the vehicle involved in an accident and damaged is repaired in the best possible way, there will be a decrease in the market exchange value due to the accident that will be recorded in TRAMER records.

Conditions for Loss of Vehicle Value
The following conditions must be met:
- Having a double-sided accident
- Not being 100% at fault in the accident
- The damage to your vehicle should not be due to previously damaged parts.
- Your vehicle should not be a vehicle with a record of heavy damage.
- Other Conditions: Claims for loss of value due to damage to short-term rental vehicles, taxis, minibuses, test vehicles, collection and antique vehicles, and damage to wheeled/tracked and armored social intervention vehicles, municipal buses, road sweeping vehicles, fire trucks. Loss claims are excluded from the coverage.
From Whom Can Vehicle Value Loss Be Requested?
The party whose fault caused the accident is obliged to cover the damage to the vehicle of the party who was not at fault in the accident. Therefore, a vehicle owner whose vehicle has lost value despite not being at fault in a traffic accident can apply to the insurance company that issued the traffic insurance policy of the at-fault vehicle that caused the accident.
Is There an Age and Mileage Limit for Vehicle Value Loss?
The ‘Decision’ of the Constitutional Court, No. 2019/40, published in the Official Gazette dated 09.10.2020, has made an amendment in favor of the injured party in this regard. According to this;
Although the depreciation calculation formula and the 160,000 kilometer limit have been removed; Parts such as plastic bumper/part repairs, glass, radio/tape, tires, airbags, rims, mechanical, electrical, electronic and upholstery parts are also included in the scope of loss of value.
Vehicle Value Loss Application / How to get it?
In order to file a lawsuit, you must make a written application to the relevant insurance institution before filing a lawsuit within the limits stipulated within the scope of compulsory liability insurance. Then, the insurance company must respond to your application in writing within 15 days from the application date at the latest.
Application to the Insurance Arbitration Commission:
- Insurance arbitration commission provides an alternative way to resolve disputes.
- You can submit your vehicle value loss request in writing to the insurance arbitration commission.
- The Commission may conclude the dispute within 4-5 months depending on the workload.
- Applications can be made in person or through a lawyer.
Action in Commercial Courts of First Instance:
- It can also be requested through a lawsuit in the Commercial Courts of First Instance.
- However, in practice, the most practical and preferred way is to apply to the arbitration commission.
- The decision made by the arbitration commission as a result of the application is considered as a court order and enforcement proceedings can be carried out.
