The upper limit on residential rents aims to protect tenants from excessive rent increases by limiting rent increase rates for a certain period, taking into account economic fluctuations and market conditions. The following regulations regarding residential rents were made in the Turkish Code of Obligations No. 6098;
Provisional Article 1- (Added: 8/6/2022-7409/4 art.) In terms of residential rents, agreements regarding the rental fee to be applied in the renewed rental periods between the date of entry into force of this article and 1/7/2023 (including this date), It is valid provided that it does not exceed twenty-five percent of the rental fee of the previous rental year. The change rate is valid if the change rate in the consumer price index of the previous rental year compared to the twelve-month averages is below twenty-five percent. This rule also applies to rental agreements longer than one year. Contracts made in excess of these rates are invalid in terms of excess amount. The provision of this paragraph is also applicable to the decisions to be made by the judge in accordance with the second paragraph of Article 344.

In terms of residential rents, agreements regarding the rental fee to be applied in the renewed rental periods between 2/7/2023 and 1/7/2024 (including these dates), It is valid provided that it does not exceed twenty-five percent of the rental fee of the previous rental year. The change rate is valid if the change rate in the consumer price index of the previous rental year compared to the twelve-month averages is below twenty-five percent. This rule also applies to rental agreements longer than one year. Contracts made in excess of these rates are invalid in terms of excess amount. The provision of this paragraph is also applicable to the decisions to be made by the judge in accordance with the second paragraph of Article 344.
This regulation has been introduced only for residential rentals, and the increase in the CPI rate in the law will continue to apply to workplace rentals. After the period expires, that is, after July 2, 2024, whether the regulation will be revised or continued in the same way will be evaluated according to the rent inflation of that period.
Note: As of 02/07/2024, the rent increase rate limitation will continue to be applied as the TÜFE rate increase rule as before.
