Foreigners’ purchase of real estate in Turkey is based on Articles 35 and 36 of the Land Registry Law No. 2644. In accordance with Article 35, amended by Law No. 6302, the requirement for reciprocity in the acquisition of real estate in our country by foreign natural persons has been abolished. - Principle of Reciprocity: Latest Legal Changes and Acquisition of Real Estate by Foreigners in Turkey With the Law No. 6302 on Amendments to the Land Registry and Cadastre Law, significant changes have been made in the conditions required for real estate acquisition by foreigners. While the conditions for foreigners who want to acquire real estate in Turkey are eased with the law adopted on 03/05/2012, some restrictions continue to apply to citizens of countries with which Turkey borders. With the amendment, the law gave citizens of 183 countries the right to acquire real estate in Turkey “without the requirement of reciprocity”.
- Presidential Decree: Conditions for foreign nationals to purchase property in Turkey are determined by Presidential decrees. These decisions are made taking into account Turkey’s national security interests and international relations.
- Property Size Limitations: Foreign citizens can acquire a maximum of 30 hectares of property throughout Turkey. This limit can be increased up to two times by the President.
- Security Review: Property acquisition by foreigners may be examined in terms of national security. In this context, security investigation and archive research can be carried out.
- Required Documents: During the property purchase process, foreign citizens are required to submit documents such as passport or identity document, title deed, real estate declaration value, compulsory earthquake insurance and photograph.
